RELEASE OF LIABILITY WAIVER - VOLUNTEER AGREEMENT (2025)

Together We Rise is a 501(c)(3) non-profit organization headquartered at 560 W. Lambert Rd., Brea, California, 92821.

The Volunteer Event may be held at Together We Rise facilities or elsewhere.

In exchange for participation in the activity of the Volunteer Event organized by Together We Rise, I, the volunteer agree to the following:

1. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Together We Rise, or the employees, representatives, or agents of Together We Rise. I will comply with volunteer policies, safety rules, conduct expectations, and other directions.

2. VOLUNTEER NOT AN EMPLOYEE. I understand that I am not an employee of Together We Rise and will not be paid or compensated in any way for my services and that I am not entitled to any benefits or eligible for any benefit plans from Together We Rise.

3. ASSUMPTION OF THE RISKS AND RELEASE. I recognize and acknowledge that there are certain inherent risks associated with volunteering and I hereby release, waive, and discharge Together We Rise, its officials, officers, employees, agents, volunteers, and any other promoters, operators or co-sponsors from any and all liability, claims, or causes of action arising out of or in any way connected with the Volunteer Event. I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Together We Rise for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Together We Rise and/or the premises at which the Volunteer Event is held, whether caused by the fault of myself, my family, Together We Rise or other third parties. These risks may arise in a variety of ways and I assume and accept any and all risks of injury, illness, death, and property damage or loss that may arise from my presence at the facilities or participation as a volunteer. I agree to this on behalf of myself, my heirs, executors, administrators, and assigns.

A.COVID-19. ASSUMPTION OF RISK AND RELEASE.Further, I acknowledge and understand that while participating in any events scheduled, held, or sponsored by Together We Rise, consistent with CDC guidelines, employees, volunteers, and participants are encouraged to practice hand hygiene, “social distancing” and wear face coverings to reduce the risks of exposure to COVID-19. Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and I knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID-19, and release Together We Rise from any liability therefrom, even if arising from the negligence or fault of Together We Rise.

4. DISCLOSURE OF MEDICAL CONDITIONS. I understand that I am solely responsible for knowing my own physical condition and making my own decision about volunteering. I attest and verify that I possess the physical fitness and ability to perform the volunteer work and that I have no physical limitations that would affect my performance of the volunteer work. I have disclosed all medications and conditions relevant to my participation to Together We Rise staff. I understand that Together We Rise needs such information because some medication side effects or medical conditions could affect my safety or that of others. I consent to sharing this information with health professionals or first responders should I become ill or injured while at Together We Rise facilities.

5. MEDIA RELEASE.I consent to the use by Together We Rise of my name, statements, voice, image, and likeness, in any format, including photos, video, audio, film, sound recording, tapes, other recordings, print, or electronic (together, the “Materials”), and grant to Together We Rise the irrevocable, unrestricted, perpetual, and worldwide right and license to use, edit, reproduce, publish, transmit, and display the Materials as Together We Rise determines, in its sole discretion, is appropriate to promote and otherwise carry out its mission. I agree that Together We Rise may make the Materials available on its website, in its publications, or through any other media now or later developed, including social networking platforms. I understand that I am not entitled to inspect or approve the use of the Materials, receive notice of their use or publication, or receive any payment.

6. INDEMNIFICATION. I agree to indemnify and defend Together We Rise, its directors, agents, employees, etc. against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's participation in the Volunteer Event and/or use of or presence upon the facilities of Together We Rise and/or the premises at which the Volunteer Event is held.

7. FEES. I agree to pay for all damages to the facilities of Together We Rise and/or the premises at which the Volunteer Event is held caused by any negligent, reckless, or willful actions by me or my family.

8. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under California law.

9. SEVERABILITY. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.

10. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure. Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and judgment may be entered upon it by any court having proper jurisdiction.

11. COVID-19. In light of the ongoing spread of COVID-19, individuals who fall within any of the categories below should not engage in the Volunteer Event. By attending a Volunteer Event, you certify that you do not fall into any of the following categories:

A. Individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include fever, cough, and shortness of breath, among others;

B. Individuals who have traveled at any point in the past fourteen (14) days either internationally or to a community in the U.S. that has experienced or is experiencing sustained community spread of COVID-19; or

C. Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment.

I certify that I do not fall into any of the above categories.

​I have read this Agreement and understand its terms. I sign it freely and voluntarily. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
